These Terms of Service (“Terms”) govern your access to and use of the CIM Build website and services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you are agreeing to these Terms on behalf of a business, you confirm you have authority to bind it. These Terms are an agreement between you and Estimate Labs Pty Ltd (“CIM Build,” “we,” “us,” or “our”).

1. Accounts and Acceptable Use

You are responsible for your account credentials and all activity under your account. You agree to use the Services only for lawful business purposes and not to: (a) breach any applicable law or regulation; (b) send unsolicited or unauthorised advertising (spam); (c) upload malware or attempt to gain unauthorised access to the Services or related systems; or (d) reverse engineer or resell the Services except as permitted by law. We may suspend or terminate access for breaches.

2. Customer Data and Intellectual Property

Our IP: We and our licensors own all rights, title, and interest (including intellectual property rights) in the Services and all related software, content, and trade marks. No rights are granted except the limited right to use the Services under these Terms.

Your data: You retain ownership of the project data, drawings, specifications, and other materials you submit (“Customer Data”). You grant us a worldwide, non-exclusive licence to host, process, and display Customer Data solely to provide and improve the Services for you.

3. Charges

Charges, billing frequency, and renewal terms are as set out in your order or subscription. Unless stated otherwise, charges are non-refundable and exclusive of VAT, which will be added where applicable.

4. Consumer Rights

Nothing in these Terms excludes or limits any rights you may have that cannot be excluded under applicable law, including, where you deal as a consumer, your statutory rights under the Consumer Rights Act 2015.

5. Disclaimers and Liability

The Services are provided “as is” and “as available,” and to the extent permitted by law we exclude all implied warranties. CIM Build assists with document review but does not replace professional judgment; you remain responsible for verifying outputs and for your construction, estimating, and design decisions.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law. Subject to that: (a) we are not liable for any indirect or consequential loss, or loss of profit, revenue, or data; and (b) our total aggregate liability arising out of or in connection with these Terms will not exceed the charges you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.

6. Privacy and Data Protection

Our handling of personal data is described in our Privacy Policy and complies with the UK GDPR and the Data Protection Act 2018.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have non-exclusive jurisdiction over any dispute arising out of or in connection with them.

8. Changes to These Terms

We may update these Terms by posting the revised version here. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
